Welcome to Migynae – your personalized companion offering information about common pregnancy symptoms, home remedies, over-the-counter (OTC) medication suggestions and general guidance for women who are pregnant, planning to conceive, or in the postpartum phase.

By accessing or using Migynae, you agree to be bound by these Terms.

Migynae does NOT replace professional medical advice, diagnosis, or treatment. Always consult with your doctor, midwife, or a qualified healthcare provider regarding any symptoms, medications, or remedies suggested in this app.

Application of Terms of Use

Please read these Terms of Use carefully (including the "Limitations of Liability" and "Choice of Law and Jurisdiction" sections below) before you start to use our App, as these will apply to your use of our App.

We may update these Terms of Use from time to time, including, to reflect changes in law or as a result of changes to the content of the Website or the addition of new features – it is therefore important that you refer to these Terms of Use from time to time to ensure that you are familiar with the relevant terms which will govern your use of the App. This version of the Terms of Use is effective as of 8 April 2025.

If you do not agree to these Terms of Use, you must not use our App. These Terms of Use incorporate the following Privacy Policy terms, which also apply to your use of our App

This app does not offer medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before making any medical decisions.

2. Medical Disclaimer

In line with App Store/Playstore Guidelines, this app does not replace medical consultation, offer diagnosis, or provide regulated health services.

The App contains content generated by us (or on our behalf by medical authors). The content we provide via the App is provided for general information purposes only. It is not set up to provide specific advice on which you should rely. In particular, the App (and the information which may be accessed through it) is not a substitute for professional medical care by a qualified doctor or other healthcare professional. If you are not a healthcare professional then you should ALWAYS check with your doctor if you have any concerns about your condition or treatment and before taking, or not taking, any action on the basis of the content on our App. If you are a healthcare professional then this information (including any professional reference material) is intended to support, not replace, your own knowledge, experience and judgement.

3. User Eligibility

This app is intended for users aged 18 and above.

4. User Data & Privacy

We collect minimal personal data for personalization. Data is securely stored using Firebase. Refer to our Privacy Policy for more info.

5. Remedies & Medications

All remedies and OTC medications listed are generic. They should be discussed with a healthcare professional before use. Migynae is not liable for results from their use.

6. Modifications

We reserve the right to update these terms. Continued use after changes means you accept them.

7. Termination

Access may be revoked if terms are violated.

8. User Conduct and Zero Tolerance Policy

MiGynae is committed to maintaining a safe and respectful environment for all users. We enforce a zero-tolerance policy for objectionable content, including but not limited to:

Violations may result in removal of content, account suspension, and reporting to authorities where applicable. Users are encouraged to report abusive behavior or objectionable content using the in-app reporting feature. Reports are reviewed within 24 hours, and appropriate actions are taken.

Choice of Law and Jurisdiction

These Terms of Use, and the agreement between you and us arising from your use of this App and its services, shall be governed by and construed in accordance with the laws of India.

You agree that the courts located in Ludhiana, Punjab, shall have exclusive jurisdiction over any disputes or claims arising out of or in connection with these Terms of Use, your use of the App, or the services provided herein.

If you are accessing this App from outside of India:

Use of this App is unauthorized in any jurisdiction that does not give full effect to all provisions of these Terms, including but not limited to this paragraph.

LIMITATIONS OF LIABILITY

Please read this section carefully, as it sets out the limits of our liability to you in relation to your use of the MiGynae mobile application ("App")

Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, fraud, or any other liability which cannot be excluded or limited under applicable Indian law.

To the extent permitted by law, we exclude all warranties, representations, conditions, or other terms — whether express or implied — that may apply to this App or any content within it. The App is provided on an "as is" and "as available" basis.

The MiGynae App is intended solely for informational use and general informational purposes, and is not a substitute for professional medical advice, diagnosis, or treatment. You agree not to use the App for any commercial, diagnostic, or emergency medical purposes. We are not liable for any decision made or action taken by you based on the information available in the App.

We do not warrant that the content in the App will be complete, error-free, or up-to-date. While the content is reviewed by qualified medical professionals, medical knowledge evolves, and users are encouraged to consult their doctor or a licensed healthcare provider for any medical concerns.

We assume no responsibility for third-party websites or content linked within the App. Such links do not imply our endorsement, and we will not be liable for any loss or damage resulting from their use. We (and our licensors and suppliers) shall not be liable to you for any indirect, incidental, special, or consequential damages, including but not limited to loss of data, emotional distress, or loss of opportunity, arising from:

Subject to the above, our total liability to you, in connection with the App and your use of it, whether in contract, tort (including negligence), or otherwise, shall not exceed ₹5,000 (Indian Rupees Five Thousand only). This section does not affect any legal rights you may have as a consumer under applicable law. You acknowledge that MiGynae is made available to you in reliance on these limitations of liability and your acceptance of these Terms of Use.

Intellectual Property Rights

We are the sole owner (or the authorized licensee) of all intellectual property rights in the MiGynae mobile application ("App"), including but not limited to its design, interface, content, text, graphics, audio, video, and underlying software. These works are protected by applicable intellectual property and copyright laws in India and internationally. All such rights are reserved.

You may download and/or print one copy of relevant content from the App for your personal, non-commercial use only. You may also share or reference content within a non-commercial context (e.g., with family members or health professionals), provided that:

If you download, copy, or reproduce any content from the App in breach of these Terms, your right to use the App and its materials will terminate immediately. You must, at our request, delete or return all copies of such materials.
